Employment & Labor Alert — Supreme Court Lowers the Bar for “Majority Group” Plaintiffs to Sue for Employment Discrimination

As occurs often in America’s courts, employers move for summary judgment on employees’ discrimination claims. The analytical road for most of these motions is familiar:

the employees need to show they were terminated under circumstances giving rise to an inference of discrimination based on a protected characteristic,
the employers need to produce a non-discriminatory reason for the terminations, and
the employees must proffer evidence exposing that rationale as a sham.

But for certain employees in certain courts, including the Tenth Circuit, the first hurdle was higher. That is, “majority group” employees – like white, male, or straight workers – not only needed to raise a discriminatory inference, but also demonstrate “background circumstances” suggesting they worked for the unusual employers who discriminated against the majority. Thus, members of majority groups aiming to bring wrongful termination suits under Title VII of the Civil Rights Act of 1964 bore a heavier burden than their minority-group counterparts.

That ended last week. In a unanimous decision authored by Justice Jackson, the United States Supreme Court held that the threshold burden for surviving summary judgment is the same for all plaintiffs, irrespective of group membership. Majority group plaintiffs, then, are no longer required to show additional “background circumstances” to bring Title VII employment discrimination claims.

The case – Ames v. Ohio Department of Youth Services – involved a straight woman (Marlean Ames) who worked for Ohio’s Department of Youth Services for 15 years, eventually rising from assistant to program administrator. But in 2019, the Department denied her a promotion, hiring instead a gay candidate, and demoted her to a previous position with half the pay, replacing her with another gay candidate. Ames sued, alleging discrimination on the basis of sexual orientation (a form of sex discrimination). At the district and appellate levels, her employer won summary judgment based on Ames’ failure to show “background circumstances” suggesting the Department discriminates against straight workers.

The Supreme Court reversed, striking heightened evidentiary standards for majority member groups, like the “background circumstances” standard at issue. The Court explained that Title VII prohibits discrimination against all employees on the basis of certain characteristics – with no distinction as to whether they are members of a minority or majority group. Imposing a heightened evidentiary standard on majority employees contravened Title VII’s focus on the individual, not the group.

Looking Toward the Future

Before Ames, the Tenth Circuit, which includes Oklahoma, was one of a number of federal appellate courts to impose this “background circumstances” standard on majority member plaintiffs. These courts reasoned use of the standard was appropriate because employers typically discriminated against minority or historically disadvantaged employees, and not majority or historically privileged employees. After Ames, this standard is no longer an impediment: any plaintiff who can offer facts raising an inference of discrimination based on a protected characteristic, like sex, can unlock the courthouse doors and force an employer to explain the legitimate, business reasons for its actions.

Employers should prepare for increased litigation in the wake of Ames. Beyond lowering the barriers to suit, the Court said, in one voice, the rationale animating the “background circumstances” standard doesn’t change Title VII’s plain text and its protection of the individual, rather than the group. If an employer has hiring (or any other) practices that either explicitly or implicitly consider whether employees or applicants belong to minority or historically marginalized groups, those practices may be challenged by majority employees. Employers should review internal policies and practices accordingly – and, as necessary, seek legal counsel for instituting best practices.

In addition to internal hiring practices, employers should anticipate claims of discrimination with respect to disciplinary and termination decisions. Now is the time for employers to ensure they have policies and practices in place to document their legitimate business reasons for any adverse employment decisions. Further, employers should train supervisors and managers to understand and appropriately implement those policies and practices to avoid claims of discrimination.

The midstream sector of the energy industry presents a complex landscape shaped by legal, contractual, and economic variables. As companies pursue infrastructure development and operations, a clear understanding of contractual nuances, regulatory shifts, and litigation trends is essential.

This summary highlights the top five considerations professionals should keep in mind when navigating midstream energy projects in 2025 and beyond, which were recently presented at GableGotwals’ Sixth Annual Energy Market Drivers and Current Legal Issues Seminar.

Contract Structures and Economic Terms
Midstream agreements vary widely but typically revolve around gathering, processing, and transportation services. Key elements include:

- Fee structures (pure fee vs. percentage of proceeds/“POP”)
- Incentives (e.g., drilling incentives, minimum volume commitments)
- Term lengths and creditworthiness of counterparties. Understanding how these components interact with market conditions and jurisdiction-specific laws is critical for negotiation and enforcement.

Dedication Language and Litigation Risk
Dedication clauses—where producers commit specific wells, pads, or acreage to a midstream provider—have been the subject of repeated litigation over the last nine years, generally in bankruptcy courts.

- The central issue has been whether dedications are “covenants that run with the land” and therefore remain binding, and whether such dedications can be rejected in bankruptcy proceedings.
- Although initially believed that a dedication found to “run with the land” could not be rejected in bankruptcy proceedings, recent decisions suggest that a dedication may be rejected regardless of whether it runs with the land.
- Even though it may not make a dedication “rejection-proof,” parties should still take care in drafting dedication provisions to meet the requirements of a covenant running with the land so that the dedications are more likely to remain binding on successors to the contract.
- However, given the challenges to dedications, midstream entities should consider other alternative methods to secure their long-term investment in building and developing gathering and processing systems.

Regulatory Environment and LNG Pipeline Developments
The recent lifting of the Department of Energy’s pause on LNG pipeline approvals signals a regulatory rebound. However, the process remains politically charged:

- Public comment and litigation are shaping timelines.
- Regulatory uncertainty continues to affect project planning and international LNG export strategies. This evolving environment necessitates careful tracking of federal actions and local implications.

Impact of Tariffs on the Midstream Sector
New tariffs, particularly on steel and aluminum, are affecting project economics:

- Increased costs for pipelines, refineries, and infrastructure development.
- Retaliatory tariffs from other countries may decrease the competitiveness of U.S. energy exports.
- Market volatility resulting from trade disputes can hinder long-term planning. Companies must adopt procurement strategies and assess supply chain vulnerabilities in response to these pressures.

Condemnation Proceedings and Legislative Reform in Oklahoma
Land acquisition for pipeline projects often involves condemnation, a process vulnerable to delays and high costs:

- Condemnation proceedings are inherently contentious and pose unique legal challenges.
- House Bill 2036 seeks to revise Oklahoma’s outdated statutes by limiting fee-shifting provisions that currently disadvantage companies.
- Understanding the local legal landscape, particularly in states like Oklahoma, is vital to mitigating risk in land disputes.

Conclusion

I was a Forward Observer before commissioning as an Infantry Officer in 2010. I branch-detailed as an Artillery Officer in 2013. During our deployment to Kandahar, my unit traveled with local security elements and conducted fire support missions while training the Afghan military on how to use artillery assets to support maneuver elements. In Kabul, we served as a quick-reaction force for urban operations and provided personal security details for local leaders.

I think we helped many communities and locals while we were deployed, particularly women. Providing security for the areas we occupied allowed representatives from the State Department to build roads, schools, and wells in remote areas that were entirely reliant on bad actors for decades before the invasion.

I now have gratitude for small comforts. Coming home to family after working in an air-conditioned office is pretty awesome compared to wandering around in the woods or desert for weeks at a time.

How does military service shape your view of leadership and teamwork?
Being in the military has developed my interpersonal skills in a unique way – usually for the best. Platoons and companies are comprised of dozens of people from different areas and backgrounds, and that experience helps you learn how to find common ground and relate to other employees and clients.

The best leaders are typically those who don’t ask anyone to do something they aren’t willing to do (or have done) themselves and don’t care who gets credit for a task being accomplished. Those traits are the two best and earliest indicators of good leadership, and it’s infectious.

How can we better support veterans?
Military service really is a cheat code and head start for young people, even if they were to join the reserves or national guard rather than active duty. After a 6-12 month initial training period (depending on your job), your commitment is typically two days per month and two weeks per year. In exchange, you receive a free education, healthcare, supplemental income, and work history. However, recruiting is at an all-time low because qualified candidates think it’s too difficult.

Post-9/11 veterans have the resources they need to thrive, particularly in comparison to previous generations of veterans. GableGotwals, in particular, does an outstanding job of recognizing service and supporting employees with continuing service obligations.
