January 8, 2025 | GableGotwals represents Jet Commercial Construction, LLC and its owners, Steve Rich and Jake Sharp, in a negligent-misrepresentation and breach-of-contract dispute arising from the construction of a fountain at Caesars Place in Las Vegas, Nevada. The Firm’s litigation team moved to dismiss the individual claims due to lack of personal jurisdiction. The trial court denied the motion and issued subsequent adverse rulings against the individual owners on discovery issues. The litigation team filed a petition for a writ of prohibition with the Nevada Supreme Court, which the Court ultimately granted and directed the trial court to dismiss Rich and Sharp.

Lazy S Ranch Properties LLC v. Valero Terminaling and Distribution Company, — F.4^th —, 2024 WL 564323 (10^th Cir. February 13, 2024)

Lazy S Ranch and Valero are litigating an oilfield pollution case in which the Ranch claims damages ranging from $13 million to more than $43 million. The Ranch’s sole evidence of legal injury was the presence of an odor of refined hydrocarbons emanating from one place, a cave, on the 6,165-acre ranch. Two witnesses testified the odor in the cave was strong enough to give them headaches. The Ranch did not contest scientific testing evidence showing the trace amounts of contaminants found on the Ranch were not harmful or dangerous. The Ranch never notified a regulatory agency of the contamination, workers on the Ranch continue to drink the water through a filter, and cattle continue to graze on the property. No one ever told the Ranch that its water was unsafe to drink or sell. In addition, the Ranch presented no evidence of intentional trespass or breach of ordinary care by Valero or that Valero even knew there was a leak from its pipeline. The Ranch identified only one leak from Valero’s pipeline – a visible drip from a mechanical union two miles south of the cave where the odor was found. There had been a substantial release in 2018 six miles away from the Ranch; however; the Ranch presented evidence from experts that the trace contaminants found were fresh and could be no more than three to six months old.

The United States District Court for the Eastern District granted summary judgment for Valero, finding there was no evidence to support a genuine issue of material fact to support any of the Ranch’s claims, including not only the trespass, negligence, and constructive fraud claims, but also its claims for public nuisance, private nuisance, and negligence per se. On February 13, 2024, a Tenth Circuit three-judge panel, in a split decision, reversed and remanded the nuisance and negligence per se claims for trial. Judge Phillips dissented from the majority.

Key Holdings

• “Under 27A O.S. § 2-1-102(12), [a landowner] can “succeed by showing either pollution amounting to a nuisance or pollution rendering the environment harmful, detrimental, or injurious.” (emphasis added) The landowner “need not show both.”
• With respect to waters of the state, “the finding of a private nuisance based on the unlawful release of substances into the environment necessitates the finding of a public nuisance also.”
• If a genuine issue of material fact exists as to nuisance in a pollution case based on 27A O.S. § 2-5-105(A), then it also exists as to a claim for negligence per se.
• Oklahoma Administrative Code § 165:10-7-5 applies to a claim for negligence per se arising from alleged oilfield contamination.

Based on these holdings, the majority found that Lazy S Ranch had established a genuine issue of material fact sufficient to support their claims of nuisance and negligence per se by presenting generalized evidence that one or two people felt a headache while near an odor of hydrocarbons in a cave. While agreeing “the law does not allow relief on the basis of an unsubstantiated phobia,” the majority also pointed to other evidence in support of its reversal that would typically fall into that exact category: (1) one witness testified that he feared igniting a lighter (and so he didn’t); and (2) the Ranch owner decided to forego water sales and prohibit third parties from recreating on the property as a result of the cave odor even though no one told him the water on the Ranch was unsafe to drink or sell.

Analysis. The Tenth Circuit’s decision will likely make it more difficult to obtain summary judgment in oilfield contamination cases. Despite developing very favorable scientific evidence establishing that any hydrocarbon contamination was well within safe standards, Valero’s legal arguments were derailed by two witnesses who testified they got headaches while standing in a cave that smelled like diesel fuel. This relaxation of objective, standards-based evidence for pollution cases will lead to more litigation and result in more trials.

On February 9, 2024, the United States Court of Appeals for the Tenth Circuit affirmed the dismissal of a former employee’s claims for disability discrimination, but reversed dismissal of his alternative age discrimination claim. Cline v. Clinical Perfusion Systems, No. 22-5107 (10th Cir. Feb. 9, 2024). The new opinion offers a few notable lessons for employers who must decide what to do when an employee cannot return to work due to an extended illness or impairment. 

Facts

Charles Cline lost consciousness while stopped at a red light in Tulsa, Oklahoma. He was resuscitated by emergency responders, but the incident resulted in an extended stay in the ICU at St. Francis Hospital. While in the ICU, he was heavily sedated and could not speak, eat, or care for himself. Eventually he recovered enough to be transferred for inpatient rehabilitation, but his impairments were expected to last “more than six months.”

At that point, Cline’s employer decided to terminate and declined a request from Cline’s wife to keep his job open until Cline could return. Cline’s recovery was faster than expected, and his physician released him four months after the incident occurred. According to the allegations, Cline’s employer had hired two new employees to fill his position, both of whom were younger and less experienced. Cline was 61 at the time.

Cline asserted claims for disability discrimination under the Rehabilitation Act, the Affordable Care Act (ACA), and the Oklahoma Anti-Discrimination Act (OADA), and also for age discrimination under the OADA. The district court dismissed Cline’s claims, concluding he could not plausibly allege that, at the time of termination, he would have been able to perform his job functions with reasonable accommodation, and also concluding that Cline was unable to establish that his age was a but-for reason for his termination.

Tenth Circuit Analysis

The Tenth Circuit affirmed dismissal of Cline’s disability discrimination claims, noting the only possible accommodation for Cline would have been a leave of absence, and at the time of termination, Cline would not have been able to specify a reasonable date for his return that was less than six months. Thus, Cline could not request a reasonable accommodation that did not pose an undue hardship on his employer. However, the appellate court also reversed the lower court’s dismissal of the age discrimination claim, noting that litigants are entitled to plead inconsistent legal theories and inconsistent facts. Thus, Cline could plausibly allege, and did, that “age was the factor that made a difference” in his termination, even while also alleging that his disability was the determinative factor. The court remanded Cline’s actions for further proceedings on the age discrimination claim.

Key Takeaways for Employers

• A brief leave of absence for medical treatment or recovery can be a reasonable accommodation. However, an employee’s leave request must assure the employer that the employee will be able to resume essential functions of their job by an estimated date that is in the “near future.” A leave of absence exceeding six months is per se Whether a leave request with an estimated date less that six months will be considered “reasonable” depends on the particular fact situation, including the essential functions of the job and the impact of the requested leave on business operations.
• Engaging in a good faith interactive process is crucial. This involves dialogues with the employee about the nature of their limitations, the duration of the required leave, and potential alternative accommodations.
• Documentation is vital. Maintaining thorough documentation of the interactive process, the rationale behind accommodation decisions, and any communications with the employee is vital. This documentation can be instrumental in defending against potential claims.
• Always be truthful. It can be hard to tell an employee who is already suffering from extended illness or impairment that they are being terminated because they can’t return to work soon enough. Cline’s employer allegedly told Cline’s wife it was having financial difficulties, which he alleges was false. This opened the door for Cline’s argument of pretext and his age discrimination claim. Had the employer communicated the straight and hard fact that it simply could not afford to leave the position open for an indefinite period, there would be no liability exposure.
• Legal and Policy Review: Employers should review their policies on leaves of absence and accommodations to ensure they are in compliance with current legal interpretations.
